Terms of Service

By booking ‘A Wonderful Nest’ through the website http://www.awonderfulnest.pt you are entering an agreement made between Isabel Vargem (referred as the “Host”) and all the members of the holiday rental (referred as the “Guest(s)”) staying at the accommodation named ‘A Wonderful Nest’ (referred as the “Property” and also referred as the “House” when it is just the interior area of the building and the “Patio” when it is just the enclosed exterior private area including the plunge pool), with registration number 55008/AL.

When a Guest submit a booking via our online reservation system, the Guest will receive a booking confirmation email. This email confirms the stay and the agreement between the Guest(s) and the Host.

By clicking the ‘I agree to the Terms & Conditions’ online checkbox button, the Guests agree to all of the Booking Conditions and Terms listed here without exception. All Guests must have read the terms and conditions contained herein and accept them in full. Completion of the booking form online will represent that all Guests have agreed to these terms and conditions. Liability under this Agreement is joint and several between all Guests.

Property Details and Policies

‘A Wonderful Nest’ is especially designed for couples and has one queen sized bed, so it is able to receive 2 people. We don’t take children, but you can bring your infant if he is under 2 years old. A travel cot and high chair will be provided if needed. Please remain cautious if your infant gets near the water.

The property is to be occupied only by the persons specified on the booking form and for holiday purposes only.

All areas of the House are accessible to the guests, as well as the private Patio and the plunge pool.

You must be at least eighteen (18) years of age at the time of booking.

The Property has a minimum rental period of 4 nights and a maximum rental period of 15 nights.

Smoking is not allowed inside the House. However, it is allowed on the Patio.

Pets are not allowed inside the Property.

No parties or events are allowed under any circumstance.

The property is not suitable for children.

Payment

The Guest must make full payment of the accommodation cost in order to complete the booking.

The payment must be made through Bank Account, Credit Card or Paypal and is processed through Paypal’s secure channels.

Check-in and Check-out

The Guests may arrive no earlier than 4pm on the arrival day and must depart no later than 11am on the departure day unless previously agreed with the host a different schedule. Failure to adhere to these times can result in additional rental charges plus a fee for delayed or hindered access to the property by cleaners and caretakers.

Guest Obligations

The Guests are responsible for leaving the property clean, tidy and in a similar condition as they found it. Any Loss, breakage or damage, however minor, must be reported immediately by the Guest to the Host or his representative, who will make the appropriate charge for repair or replacement. The Guest will also be responsible for the cost of any excessive cleaning that may be required.

Guests agree not to exceed the number of people stipulated in the Property description on the website, not to allow other people on the Property and not to cause annoyance or become a nuisance or to cause excessive noise to occupants of adjoining premises.

Guests further agree not to use the Property for any commercial purpose including without limitation assigning or sub-letting the same or otherwise allowing anyone to occupy it that has not been notified as part of Guest members to the Host.

The Guest must allow the Host or its representatives reasonable access to the property without notice to the Guest.

Liability

The Guests at ‘A Wonderful Nest’ are insured against personal accidents. The insurance can be activated and will be taken forward with Insurance Company and abbey to its own regulations.

Save in respect of any death or personal injury claim caused by the negligence of the Host, neither the Host nor any of its representatives can accept liability for any damage, expense or loss of any nature whatsoever suffered by any person(s) from any cause whatsoever.

Save in respect of any death or personal injury claim caused by the negligence of the Host or its representatives, any other liability of the Host or its representatives under this Agreement shall be limited to the rental value of the relevant booking at the Property.

Neither the Host nor its representatives shall be liable to the Guests for any loss of profit, consequential loss or other indirect losses under the terms of this Agreement. Guest vehicles and their accessories and contents are left entirely at your risk.

For the avoidance of doubt, the Host and its representatives take every care to ensure that the accuracy of property descriptions and information contained on the website of ‘A Wonderful Nest’ are correct at the time of publication. However, in the event of any good faith error, neither the Host nor its representatives can accept any liability. There are no warranties, conditions, guarantees or representations as to description merchantability or fitness for a particular purpose or other warranties, conditions, guarantees or representations whether express implied by statute or otherwise oral or in writing except as provided herein or such as cannot be excluded by law.

The use of any amenities, where offered, such as kitchen appliances, etc is entirely at the user’s risk and no responsibility can be accepted by the Host for any death or personal injury (save to the extent that such death or personal injury was caused by the negligence of the Host or its representatives). No responsibility whatsoever is accepted by the Host’s representatives, for any such death or personal injury (save to the extent that such death or personal injury was caused by the negligence of its representatives). No liability for any other loss or damage in connection with the use of such amenities is accepted.

Non-Availability of Facilities / Amenities

The Host reserves the right to alter or withdraw without prior notice facilities and/or amenities which have been advertised, where reasonably necessary due to repairs, maintenance or any other circumstances beyond their control.

Booking Alterations

Alterations to a booking can be made depending on availability and within a minimal number of days in advance.

If the Guest wishes to add extra nights to the stay it may be done depending on availability and immediate payment of the extra nights. If the Guest wishes to add nights to the stay they should contact the Host and require such alteration. The Host will confirm availability and, if available, the Host will request the payment of extra nights. The process is completed when the payment is done and the Guest receives a confirmation email with the new dates.

If the Guest wishes to remove nights from the stay it may be done depending the number of days remaining before check in date. Dates can only be removed from the stay if requested up to 15 days before the check in dates. A minimum of stay of 2 nights must still be obliged. If the Guest wishes to remove nights to the stay they should contact the Host and request such alteration. The Host will send email confirmation and arrange a refund for the nights in question. The process is completed when the refund is made and the Guest receives a confirmation email with the new dates.

Cancellation by Guest

If a Guest needs to cancel a booking he/she must inform the Host immediately.

A full refund will be made if the cancellation is made up to 15 days in advance before the check in date.

Cancellations made less than 15 days before the check in date are non-refundable.

Cancellation by Host

If the Host is affected by circumstances which are beyond their reasonable control (including without limitation flood, storm, fire, employment strikes, urgent unforeseen repairs required to Property, telecommunications access problems, destruction or damage of the Property or road blockages) then the Host shall notify the Guest immediately of the extent and nature thereof. In case of necessary cancellation, the Host will refund all monies paid.

Complaints

Any complaint must be taken up immediately by the Guest with the Host or his representative who must be afforded the opportunity to address the issue raised.

General

This Agreement and any document referred to in this Agreement constitutes the entire agreement, and supersedes any previous agreement, between the parties relating to the subject matter of this Agreement.

The failure to exercise or delay in exercising a right or remedy provided by this Agreement or by law does not constitute a waiver of the right or remedy or a waiver of other rights or remedies. No single or partial exercise of a right or remedy under this Agreement shall prevent any further exercise of the right or remedy of the exercise of any other right or remedy.

Except as expressly provided in this Agreement the rights and remedies contained in this Agreement are cumulative and not exclusive of any rights or remedies provided by law.

Nothing in this Agreement shall be construed as creating a partnership between the parties or as constituting either party as the agent of the other party (save as expressly set out in this Agreement) for any purpose whatsoever and neither party shall have the authority or power to bind the other party or to contract in the name of or create a liability against the other party in any way or for any purpose.

The Host and its representative shall be entitled to perform any of the obligations undertaken by them and to exercise any of the rights granted to them under this Agreement.

A Guest may not assign or transfer or purport to assign or transfer a right or obligation under this Agreement.

This Agreement is governed by, and shall be construed in accordance with, Portuguese law and the parties hereby submit to the non-exclusive jurisdiction of the Portuguese courts.
